Warnings: Using human rights and democracy as a cause to apply for refugee status

The right of
asylum (sometimes called right of political asylum) is an ancient
juridical concept, under which a person persecuted by
their own country may be protected by another sovereign
authority, such as another country or church official,
who in medieval times could offer sanctuary.
But, not everyone who flees
their country is refugee. To apply for refugee status, they normally need to
establish individually that their fear of persecution is well-founded. That’s
why some try to cause troubles, especially political ones, to draw attention
from international human rights organizations and anyone who cares.
According to analyses, nearly
one out of every 10 illegal immigrants is demanding asylum, using “magic words”
as a political dissident to claim they fear their home country, and apply for
refugee status. That’s what is happening with Vietnamese cases.
Now in Vietnam there are many individuals who
want to resettle to another country, mostly for economic goals. They dream to migrate
to rich countries like the U.S. and European nations to have more opportunities
to get benefits for themselves. As the United States, it has a legal process
for that immigrant to seek legal residency and eventually citizenship. Many
immigrants, however, don't have such legal status and are thus undocumented. As
such, they are subject to "removal" or deportation from the United
States.
So, they try to score with the
U.S. as anti-Vietnam, or more correctly anti-communist elements who are being
persecuted by the Vietnamese authorities. Moreover, some ethnic individuals in
the northern regions, in the Highland and the Cham, Khmer people who were
deceived by hostile forces to go abroad for anti-Vietnamese activities. Because
their migration alone have caused bad reputation for Vietnam in human rights
and democracy.
It can be listed out some
typical cases as Cu Huy Ha Vu, Pham Minh Hoang, etc and many extreme bloggers
who have spread distorted and slanderous articles about the Party and State of
Vietnam. Some have achieved their goals, some did not and some are still in
prison for their crimes. This trick is not so unfamiliar to the Vietnamese
government, people and even overseas Vietnamese, but still it is a miraculous
cure for those who want to change their life abroad.
This article aims to awake other states before
considering to grant refugee status for those opportunists, to not hurt
relations between Vietnam and these countries./.

Governments normally guarantee the basic human rights and physical security of citizens. But when civilians become refugees this safety net disappears.
Countries may not forcibly return (refoulement) refugees to a territory where they face danger or discriminate between groups of refugees. They should ensure that refugees benefit from economic and social rights, at least to the same degree as other foreign residents of the country of asylum.
For humanitarian reasons, states should allow a spouse or dependent children to join persons to whom temporary refuge or asylum has been granted.
A refugee has the right to safe asylum. However, international protection comprises more than physical safety.
Refugees are required to respect the laws and regulations of their country of asylum.
Some countries, particularly in western Europe, argue that civilians fleeing generalized war or who fear persecution by non-governmental groups such as militias and rebels, should not be given formal refugee status.
the origin of the persecution should not be decisive in determining refugee status, but rather whether a person deserves international protection because it is not available in the country of origin.
People who apply for refugee status normally need to establish individually that their fear of persecution is well-founded.
Persons who have been determined, under an equitable procedure, not to be in need of international protection are in a situation similar to that of illegal aliens, and may be deported.
a person accused of these or other non-political crimes, whether innocent or guilty, may also be persecuted for political or other reasons, and is thus not necessarily excluded from refugee status. Furthermore, people convicted of the ‘crime’ of political activism may well be refugees.
