Do not deliberately misinterpret the civil and political rights

Regarding the legal measures of Vietnam applied to some offenders for conducting propaganda against the State of the Socialist Republic of Vietnam to Clause 2, Article 88 of the Criminal Code, some people  recently have further expressed the view that everyone has the right to freedom of speech, expressing his opinion that no one is banned... They were based on the International Covenant on civil and political rights to protect that views and said that Vietnam had violated the right to freedom of speech.
It should be said immediately that people with such views have deliberately misinterpreted the International Covenant on Civil and Political Rights. To ensure human rights, the international conventions  including the International Covenant on Civil and Political Rights especially focus on vital interest of every country such as maintaining peace, stability, security and social order as well as against terrorism... Paragraph 3 of Article 19 in the International Covenant on civil and Political Rights clearly stipulate the implementation of the right to freedom of expression. Accordingly, people must have rights to have the duty and responsibility in particular when exercising their rights. This right can only be restricted by law and are necessary because of “Respecting the reputation and freedom of others; protecting national security, public order, public health or morals”.
Thus, although the rights to freedom of peaceful expression... are recognized by the world, once these rights affect national security, public order of a certain country, that will be limited. In addition, Article 20 of the International Covenant on Civil and Political Rights also prohibits political propaganda, war cheerleading, as well as all forms of hatred, incitement to discrimination, hostility or stimulation of violence between nations, races and religions.
Article 88 of the 1999 Criminal Code of Vietnam stipulates: “Conducting propaganda against the Socialist Republic of Vietnam” is entirely consistent with the International Covenant on Civil and Political Rights. On the other hand, the content of Article 88 of the Criminal Code is necessary and consistent with the actual situation of Vietnam - a country that had experienced many years of war against the invaders to regain peace, independence and freedom to the nation. However, the hostile forces have never given up political ambitions, especially in recent years they foster using foreign elements and organizations to collude with the reactionary elements in the country for propaganda, incitement of subversion against the State of Socialist Republic of Vietnam.

Every country should have its own legal institutions to ensure social order and national security. Freedom outside the lagal framework will make the world unstable.

All international organizations must stand on other countries’ position to review situation of civil and political rights. It can not be applied legal system of this country for other ones.

No one in Vietnam is banned freedom of speech at all. If your speech is not true then society will condemn you.
