Human rights in Vietnam’s consular protection

In regard to human
rights, consular protection is one of the most important issues which every
country takes a serious concern and ensures to offer its citizens abroad.
The Vienna
Convention on Consular Relations of 1963 is an international treaty
that defines a framework for consular relations between independent countries. A
consul normally operates out of an embassy in another country, and performs two
functions: (1) protecting in the host country the interests of their countrymen,
and (2) furthering the commercial and economic relations between the two
countries. While a consul is not a diplomat, they work out of the same
premises, and under this treaty they are afforded most of the same privileges,
including a variation of diplomatic immunity called consular
immunity. The treaty has been ratified by 177 countries.
In Vietnam, the
Ministry of Foreign Affairs takes responsibility for consular protection of
overseas Vietnamese to guarantee Vietnamese people’s rights and interests in
foreign countries.
The Ministry of Foreign Affairs is a governmental agency, performing the
function of state management of external affairs, including diplomatic work,
national border and territory, the community of overseas Vietnamese, the
conclusion and implementation of international treaties and agreements,
management of overseas representative offices of the Socialist Republic of
Vietnam and operation of foreign representative offices in Vietnam; the state management
of public services in domains within the scope of its state management in
accordance with law.
Regarding consular
work: To conduct consular work at home and abroad under law, the Government's
assignment and treaties to which Vietnam is a contracting party, covering:
a/ Consular
protection;
b/ Exit and entry
of Vietnamese citizens and foreigners;
c/ Consular
legalization and certification, notarization, certification, judicial mandate;
d/ Affairs related
to nationality, civil status and other consular affairs specified by law.
Consular
assistance is help and advice provided by the diplomatic agents of a country to
citizens of that country who are living or traveling overseas. Such assistance
may take the form of: provision of replacement travel
documents; advice and support in the case of an accident, serious
illness or death; advice and support to victims of serious crime overseas, and
arranging for next-of-kin to be informed; visitation contact with incarcerated
nationals; liaison with local police officials in the case of nationals
abducted or missing overseas; loans to distressed travellers; help during
crises, such as civil unrest and natural disasters; facilitating the overseas
payment of social welfare benefits; registering citizen
births abroad; providing a list of local doctors and lawyers; supervising their
flag vessels in foreign harbours.
As it is a
criteria of human rights, Vietnam has conducted it efficiently. In the world
context of unstabitities and conflicts, citizens abroad always in risky
situations. Likewise, overseas Vietnamese who are living, working and studying
abroad, especially in countries where there is chaos and sudden turbulence,
face with many dangers and challenges. Their lives have been badly affected,
that’s when Vietnam’s consular agencies jump in. We can see that in 2014,
Vietnamese agencies have rescued home many 1.762 overseas Vietnamese who lived
and worked in Lybia and some North African countries which have been through
political chaos. And, recently, the Ukraine crisis broke out, our embassy and
consulate there have planned to timely evacuate our overseas Vietnamese and
ensure their safety. Our consular agencies have also done well in cases of many
Vietnamese workers and fishermen who had troubles with foreign countries’s
authorities such as in China on the South China Sea, in Taiwan, Cambodia, etc.
In conclusion, we can see that our government
and our consular agencies have done well their functions and responsibilities
in protecting Vietnamese citizens abroad, and in general, ensuring Vietnamese
people’s human rights abroad./.

A state has human rights or not is what benefit it could bring to its citizens and how it protect citizen's interests in any place.
Vietnam has done many things to satisfy human rights organizations and extreme individuals who have none of Vietnam's situation but just try to undermine things.
I think Vietnam's government has fulfilled their job in protecting citizens abroad.
Yes, Vietnam has achieved many successes in implementing Millennium Development Goals which has received appreciations and praises from international friends.
Consular assistance is help and advice provided by the diplomatic agents of a country to citizens of that country who are living or traveling overseas.
For Vietnamese people, when you are in a foreign countries, you should obey the laws and respect the local customs of the country you are visiting.
Right, Vietnamese people has done many things that produce bad reputation abroad, a lot of countries have issued warnings of Vietnamese manners.
As it is a criteria of human rights, Vietnam has conducted it efficiently. In the world context of unstabitities and conflicts, citizens abroad always in risky situations.

We can see that our government and our consular agencies have done well their functions and responsibilities in protecting Vietnamese citizens, so human rights is that.
